Fictitious Business Name Filing
Fictitious Business Name Statements can be filed, or copies obtained either in person or by mail at the County Clerk-Recorder’s Office.  You need to research the Fictitious Business Name Index to make sure the name you are considering is available.

If requested by mail, the turnaround time is approximately two weeks. If requested in person, the transaction is completed while you wait.  If you choose to come into our office, you will be required to show a valid government issued picture identification in order for us to process your Fictitious Business Name form.

The form is available at the County Clerk-Recorder’s Office, or may be downloaded in the Forms section on the right side of the page. If you need a form mailed to you, please send a request and a self-addressed stamped envelope to the County Clerk-Recorder’s Office.

We accept cash, pre-printed checks, credit and debit cards.  Credit and debit cards are subject to an additional service fee. If you intend on using a check, please make sure the address on the check is the same as your picture identification.  We cannot accept crossed out information on checks.

If you are a limited partnership, corporation, or limited liability company, you must also submit a copy of your filed articles from the California Secretary of State.

Note: Effective January 1, 2016, limited partnerships or limited liability partnerships, corporations, or limited liability companies must be filed with the California Secretary of State or submit a “Certificate of Good Standing” from California Secretary of State in order to file their Fictitious Business Name Statement.

Publishing, refiling, and abandonment

Publishing:  Within 30 days after a fictitious business name statement has been filed, the registrant shall cause it to be published in a newspaper of general circulation in the county where the fictitious business name statement was filed or, if there is no such newspaper in that county, in a newspaper of general circulation in an adjoining county. If the registrant does not have a place of business in this state, the notice shall be published in a newspaper of general circulation in Sacramento County. The publication must be once a week for four successive weeks and an affidavit of publication must be filed with the county clerk where the fictitious business name statement was filed within 30 days after the completion of the publication

Refiling:  If a refiling is required because the prior statement has expired, the refiling need not be published unless there has been a change in the information required in the expired statement, provided the refiling is filed within 40 days of the date the statement expired.

Abandonment:  Upon ceasing to transact business in this state under a fictitious business name that was filed in the previous five years, a person who has filed a fictitious business name statement shall file a statement of abandonment of use of fictitious business name. The statement shall be executed in the same manner as a fictitious business name statement and shall be filed with the county clerk of the county in which the person has filed his or her fictitious business name statement.
